Welcome to Mostly Board (“the Service”), operated by Armstrong Marketing (“we,” “us”). By accessing mostlyboard.com or creating an account, you agree to these Terms of Use. If you do not agree, please do not use the Service.
1. What the Service is
Mostly Board publishes market information for specialty crops — shipping-point (FOB) prices, terminal market prices, shipment movement, and related tools — assembled from USDA Agricultural Marketing Service Market News data, together with account features such as watchlists, saved views, price alerts, pricebooks, and private contract tracking.
2. Informational use only
The Service provides market information for general reference. It is not trading, financial, or purchasing advice, and we make no representation that any price shown is an executable or offered price. USDA source data may contain errors, gaps, or revisions, and our processing may introduce its own. You are responsible for decisions you make based on the Service.
3. Data ownership and the USDA compilation
Underlying USDA Market News data is a work of the United States government in the public domain. The Service’s compilation is not: the normalization, correction handling, matching, aggregation, historical assembly, presentation, and derived analytics that make up Mostly Board are proprietary to Armstrong Marketing and protected as a compilation and database. Nothing in these Terms transfers any rights in that compilation to you.
4. Permitted use
You may use the Service for your own personal or internal business purposes, including viewing boards, exporting reasonable extracts (CSV/XLSX) for internal use, and sharing links to pages. Attribution is appreciated when you quote the Service externally.
5. Prohibited use
You may not: (a) scrape, crawl, harvest, or bulk-download the Service or its underlying API beyond normal interactive use; (b) systematically copy, mirror, or reconstruct the compiled dataset or any substantial portion of it; (c) resell, sublicense, redistribute, or offer the Service’s data or derivatives as your own product; (d) circumvent authentication, rate limits, or access controls; (e) use the Service to build or train a competing dataset or service; or (f) interfere with the Service’s operation. We may throttle, suspend, or terminate access that we reasonably believe violates this section.
6. Accounts, eligibility, and termination
The Service is intended for business use by adults; you must be at least 18 and able to form a binding contract to create an account. You are responsible for your account credentials and for activity under your account. Account features store the data you create (watchlists, saved views, alerts, pricebook and contract entries). Contract data you enter is private to your account and is not shared with other users or displayed publicly. You may delete your account data at any time by contacting us. We may suspend or terminate accounts, or refuse service, for violation of these Terms or to protect the Service; sections 3, 5, and 9 through 13 survive termination.
7. Privacy
We collect the minimum needed to run the Service: your email address and the content you create in your account. We do not sell personal information. Transactional email (account confirmation, password reset, alerts you enable) is sent through our email provider. Usage of public pages may be measured in aggregate to improve the Service.
8. Availability and changes
The Service is provided “as is” and “as available.” USDA publication schedules vary (no reports on weekends or federal holidays), and we may change, suspend, or discontinue features at any time. We may update these Terms; continued use after an update constitutes acceptance. We will date material changes at the top of this page.
9. Indemnification
You will indemnify and hold harmless Armstrong Marketing from claims, damages, and reasonable costs (including attorneys’ fees) arising from your violation of these Terms or misuse of the Service, except to the extent caused by our own breach of these Terms.
10. Disclaimers and limitation of liability
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. To the fullest extent permitted by law, Armstrong Marketing shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for lost profits or business decisions made in reliance on the Service, even if advised of the possibility. Our total liability for any claim relating to the Service shall not exceed the amount you paid us for the Service in the twelve months preceding the claim.
11. Governing law and venue
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in California, and you consent to their jurisdiction.
12. General
These Terms are the entire agreement between you and Armstrong Marketing regarding the Service. If any provision is held unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
13. Not affiliated with USDA
Mostly Board is not affiliated with, endorsed by, or sponsored by the U.S. Department of Agriculture. USDA Market News data is used as a public-domain source with attribution.
